Terms of Service

By installing the SpellSensei Figma plugin or using the spellsensei.com website, you agree to these Terms of Service. Please read them carefully.

1. License Grant

We grant you a personal, non-transferable, and non-exclusive license to use SpellSensei for your own design work, subject to your paid subscription or active free trial. You may not share your license or subscription with others.

2. Acceptable Use

You agree not to:

• Abuse the service by attempting to scrape data or bypass usage limits.
• Use the service for automated bulk processing of text outside of normal design workflows.
• Reverse engineer, decompile, or attempt to extract the source code of the plugin.
• Use the service for any illegal purposes or to process sensitive personal data that violates privacy laws.

3. Subscriptions & Payments

• Pricing: Our current pricing is $5 per month or $48 per year. We offer a 7-day free trial for new users.
• Merchant of Record: All payments are handled by Polar.sh. They are the Merchant of Record and handle all billing, taxes, and payment security.
• Changes: We reserve the right to change our pricing or subscription models with 30 days' notice.

4. Refund Policy

Refunds are handled according to the policies of our Merchant of Record, Polar.sh. If you are unsatisfied with the service, please contact us within 14 days of your purchase, and we will work with Polar.sh to process a refund where applicable.

5. Usage Limits & Fair Use

To ensure service stability for all users, we employ a Fair Use Policy. We reserve the right to throttle, limit, or temporarily suspend access for users who exhibit excessive API usage patterns that could degrade the service for others.

6. AI Disclaimer & Accuracy

SpellSensei uses artificial intelligence (Google Gemini) to provide spell checking and grammar suggestions. While we strive for high accuracy, AI can make mistakes. We do not guarantee that every suggestion is correct, and you are responsible for reviewing and approving any changes made to your designs.

7. Limitation of Liability

To the maximum extent permitted by law, SpellSensei shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the service. The service is provided "as is" without warranties of any kind.

8. Termination

We reserve the right to suspend or terminate your access to the service at any time, without notice, if we believe you have violated these Terms of Service or engaged in abusive behavior.

9. Governing Law

These terms are governed by and construed in accordance with the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
